Financial disclosure is a very important part of the family law process. It is mandatory for all parties to swear an Affidavit of Means.

An Affidavit of Means sets outs details of assets, income, debts and liabilities, outgoings and pension information if applicable.

With the introduction of the Case Progression Hearings it became mandatory following the filing of a Defence that both parties vouch their Affidavit of Means. This should be done within 28 days of the filing of the Respondent’s Affidavit of Means or within 21 days before the date fixed for the Case Progression Hearing whichever is earlier.

If an Affidavit of Means has been completed properly and the appropriate vouching documentation provided, in many cases discovery (which involves a more extensive financial disclosure and analysis) can be avoided thereby keeping costs to a minimum and moving the case forward as expeditiously as possible.

We have prepared some helpful guidelines to assist our clients in completing their Affidavit of Means together with a list of the appropriate vouching documentation.
