Personal Injuries
If you have suffered injury, loss, damage or expense as a result of the negligent act or omission of another party, then you may be entitled to compensation. The compensation system in Ireland is based on fault. If you have been injured and someone else is wholly or partly to blame you may be entitled to receive compensation. Accidents occur every day, at work, on the roads, in public places and private places.
When should I speak with a Solicitor? It is important to contact a Solicitor at the earliest opportunity following a personal injury and seek professional advice as there are statutory time limits within which you must bring a claim. McMahon Goldrick Solicitors have extensive knowledge and experience in this area. We aim to make every effort to ensure that our clients achieve the best possible outcome that the law will permit and we are committed to securing fair compensation on your behalf.
Subject to certain exceptions, under current legislation, you have two years from the date of your accident to take a claim for compensation. If this timeframe has expired, then your claim may be Statute Barred from proceeding.
It should be noted also that it can take time to have legal proceedings issued so you should not leave it until the last few weeks before the expiry of the statute before instructing your Solicitor.
We offer advice in relation to all possible claims for personal injury and will deal with your claim expediently and in a professional manner.
The Claims Process At our initial consultation we will take the details of your accident and injuries and analyse the strengths and weaknesses of your claim. If you have a claim for personal injury, we will inform you of your options. If you decide to proceed we can handle your claim on your behalf and explain the claims process to you.
We will write to you confirming your instructions. We will then send letters of claim to the third party and/or his/her insurers outlining the nature of your injuries. We will apply to your Doctor/Specialist for a medical report. We will also request an Engineers Report and Garda Abstract Report should they be required for your claim. We will liaise with any potential witnesses to your accident and obtain witness statements where possible.
We will then prepare your claim to be lodged in the Injuries Board for assessment.
